RE: Stoneybrook Dog Park (Parcel ID: 1102020359) Dear President Fisher:
This letter serves as official notice to Heritage Harbour Master Association (HHMA) that the dog park will be restricted to only residents of Stoneybrook and their guests. This restriction will be effective 30-days after the date of this letter.
How Did Stoneybrook Inherit the Dog Park from HHMA?
Historically, the dog park located under the high tension power lines on the 8500 block of Port Harbour Parkway and the 8500 block of Haven Harbour Way was maintained by the Heritage Harbour Master Association (HHMA) as the dog park was a common area owned by Heritage Harbour’s developer, Lennar. On January 23, 2023, the Lennar Corporation quitclaimed ownership of the dog park (Tract 101 (community common area Stoneybrook at Heritage Harbour subphase a unit 1 PI#11020.2035/9 (Parcel ID: 1102020359)) to Stoneybrook at Heritage Harbour Association, Inc.
During July 2023, the HHMA community association manager verbally advised that HHMA was no longer responsible nor will maintain the dog park. This was later confirmed by you on behalf of HHMA.
How Did Stoneybrook HOA Decide Who Uses the Dog Park?
On August 17, 2023, the Stoneybrook Board of Directors held their monthly meeting and discussion took place regarding the management of the dog park. It was confirmed the dog park is owned, insured, and now maintained by our Association. As it was found the dog park is now the property of Stoneybrook with no financial or maintenance support from HHMA or any other neighborhood within Heritage Harbour, the Stoneybrook Board of Directors unanimously voted to restrict the dog park to only residents of Stoneybrook and their guests. It should be noted there is no easement of record for user rights for the dog park.
